Amazon MGM bought the worldwide rights to the movie from Miramax for $70 million, according to Deadline, which first reported the deal.
The studio won't show the movie in theaters and will instead release it directly on Prime Video on a date that hasn't been decided yet.
Smith hasn't been in a movie since "Bad Boys: Ride or Die" in 2024, which was his first major film after he hit Chris Rock on stage at the 2022 Academy Awards.
"Bad Boys 4" made $404 million worldwide, showing that audiences still like Smith when he's part of a popular franchise. He hasn't been cast in an original movie since the incident at the Oscars. At least one other Hollywood studio seems to be reconsidering working with Smith after his reputation was damaged; the entertainment company he started with Jada Pinkett Smith, called Westbrook, recently signed a first-look deal with Paramount to create franchise films.
"Supermax" is described as a fast-paced and full of surprises action thriller about two FBI agents investigating a murder that happened in the world's most secure prison.
(Well, maybe not anymore?) Smith will play a character named Rex. More casting is happening, and production is planned to start in mid-August.
The screenplay was written by David Weil and David J. Rosen, who have worked on TV shows like "Hunters" and "Invasion."
Weil and Rosen will also be executive producers, along with associate producer Natalie Weil. Producers include Alex Heineman and Andrew Rona from The Picture Company, and Smith and Adam Fishbach will produce through Smith's company Westbrook. Miramax CEO Jonathan Glickman, president of film Alexandra Loewy, COO Thom Zadra, and senior VP Spencer Ela are also attached as executive producers.
